ACCEPTABLE USE POLICY
- Technology Lighthouse gives no forecast or warranty as to the number of enquiries raised to a particular client in respect of any web site.
- Technology Lighthouse reserves the right to remove from their servers the Web site of any client whose payment terms are either in arrears or who otherwise does not comply with our terms of business.
- Technology Lighthouse reserves the right at its sole
discretion to remove from their servers the Web site of
any client who in the sole opinion of Technology Lighthouse
has requested the publication of any information or material
which is or may be considered illegal, untrue, improper
or unsuitable for publication.
Transmission, storage, or presentation of any information, data or material in violation of any United Kingdom (or any other country) law is prohibited. This includes, but is not limited to: copyrighted material, material that is threatening or obscene, material that is "adult only" content, or material protected by trade secrets and other statue. The subscriber agrees to indemnify and hold harmless Technology Lighthouse from any claims resulting from the use of the service which damages the subscriber or any other party.
Pornography and sex-related merchandising are prohibited on any server. This includes sexual content, or direct links to adult content elsewhere. This is also true for sites that promote any illegal activity or content that may be damaging to our servers or any other server on the Internet. Links to such materials are also prohibited. Technology Lighthouse will be the sole arbiter as to what constitutes a violation of this provision.
Examples of non-acceptable content or links:
- Pirated software
- Hackers programs or archives
- Warez Sites
- Porn
- Spamming Software
Violation of indecency and obscenity laws can result in criminal penalties. - Payment will be upon completion and posting of the web site within 7 days of the date of Technology Lighthouse's invoice therefor.
- Technology Lighthouse's Liability
(a) Technology Lighthouse shall not be liable to the Client for any loss or damage whatsoever or howsoever caused arising directly or indirectly in connection with the publishing of a Web site except to the extent to which it is unlawful to exclude such liability.
(b) Notwithstanding the generality of (a) above, Technology Lighthouse expressly excludes liability for:
(i) consequential loss, damage or corruption to other software or data, or for loss of profit, business, revenue, goodwill or anticipated savings;
(ii) consequential loss or damage to the Client in respect of any visual defect of any Web site designed, developed, created, tested, installed or supported by Technology Lighthouse viewed by the Client or its clients using a web browser other than the web browser used by Technology Lighthouse at the time of the Web site's creation and Technology Lighthouse cannot guarantee that the Web site will continue to function or be viewable in its original format in subsequently developed and released versions of a browser;
(iii) the appearance of a web site when viewed by any person other than the Client viewing the web site through an agreed version of a particular web browser and cannot be responsible for the set up of any computer used to view the web site other than Technology Lighthouse's own;
(iv) the content of the web page(s) of any web site designed, developed, created, tested, installed or supported by Technology Lighthouse;
(c) The publishing and maintenance of web sites are sold on an annual basis. If the services are discontinued without allowing the annual term to be completed, Technology Lighthouse's liability shall be limited to the annual price of publishing and maintenance paid by the Client in the year in which the liability occurred.
(d) In the event that any exclusion contained in these Terms & Conditions shall be held to be invalid for any reason and Technology Lighthouse becomes liable for loss or damage that it may otherwise have been lawful to limit, such liability shall be limited to the initial cost of the web site and the annual publishing and maintenance cost paid by the Client in the year in which the liability occurred. - The Client agrees to indemnify and save harmless and defend at its own expense Technology Lighthouse from and against any and all claims of infringement of copyright, patents, trade marks, industrial designs, or other intellectual property rights affecting the web site and based upon the Client's contribution to the web site's specification.
- Domain names and email addresses are subject to availability and are at the discretion of Technology Lighthouse.
- Technology Lighthouse is unable to guarantee the integrity of web sites posted on its servers and it is the sole responsibility of each customer or client of Technology Lighthouse to check on a regular basis and to inform Technology Lighthouse accordingly if any corruption has occurred. Technology Lighthouse will, in such circumstances, endeavour to restore the Web site to the original state as soon as reasonably practical.
- Whilst Technology Lighthouse will take all reasonable steps to ensure the accessibility of Web sites posted by it, it cannot guarantee that such information will remain accessible at all times. Lack of accessibility may arise either as a result of the malfunction of any particular server or web host or otherwise.
- Whilst Technology Lighthouse will take all reasonable steps to ensure the functioning of email included in Web sites posted by it, it cannot guarantee that these will function at all times. Non-function may arise either as a result of the malfunction of any particular server or web host or otherwise.
- Any dispute is to be resolved in the Scottish courts.
Failure to comply with any of our terms & conditions will result in grounds for immediate account deactivation.
Technology Lighthouse reserves the right to change, edit, or update the policies contained in this document at any time for any reason without notice.
